Compulsory Acquisitions - Valuation approaches, tips and traps

Despite the increasing number of compulsory acquisitions occurring across New South Wales, there remains considerable uncertainty about how to value the interest being acquired.
Paul Dale, a valuer with significant experience valuing interests subject to compulsory acquisition, and Dennis Loether, head of Bartier Perry’s Environment & Planning team will lead the first part of the session which aims to provide attendees with an overview of common approaches to valuation of interests being compulsorily acquired, along with tips for better outcomes and traps to avoid.
In the second part of the session, Gavin Stuart, head of Barter Perry’s Commercial Disputes team, will lead a discussion on managing the preparation of expert evidence, whether it be for court or just to provide guidance around commercial decision making. This will cover how best to engage and instruct experts, their obligations (and yours) in the process, how to ensure any report produced is as relevant and persuasive as possible, and how to protect your interests in the process.
