Anish is a highly regarded construction lawyer known for his ability to navigate the complexities of the construction industry and provide strategic and commercial advice that ensures successful project outcomes.

He collaborates closely with principals, contractors, subcontractors, suppliers, consultants, Owners Corporations, and a diverse array of domestic and multinational businesses. His expertise spans a wide range of construction projects, including the infrastructure, education, sporting, residential, healthcare, energy, hospitality and industrial sectors.

Anish has developed strong expertise in providing advice on and preparing both standard and bespoke construction contracts, handling project delivery challenges and claims, managing defects issues, managing and resolving disputes (including through adjudication, arbitration and litigation), and ensuring adherence to relevant legislation.

He also regularly publishes articles and presents on amendments and advancements in construction law, including but not limited to the Master Builders Association and as a Course Instructor for the Institute of Civil Infrastructure.

Career highlights

  • Acting for a tier one subcontractor in relation to claims totalling $65 million from a joint venture head contractor for variations, extensions of time and delay and disruption in one of Australia’s largest infrastructure projects. The matter involved various successful adjudication applications.

  • Acting for a tier one subcontractor in the successful defence of a Supreme Court challenge to an adjudication award of approximately $13 million.

  • Acting for a national head contractor regarding an adjudication for in excess of $2 million involving latent conditions, extension of time and delay costs regarding a waste management project. The dispute was negotiated to achieve a positive outcome for my client.

  • Acting for a group of related rail engineering companies in a professional indemnity claim against their former accountants and successfully negotiating a successful outcome.

  • Successfully acting for a multinational company’s director in an application to set aside a Bankruptcy Notice based on an international arbitration award for AUD $9 million. I conceived the single successful ground to set the Bankruptcy Notice aside.
