Newcastle: Assessing Work Injury Damages claims – Part 1 Negligence, Vicarious Liability and Causation

The first in a 2 Part series presented by the Insurance Team aimed at giving you the essential know-how to assess a Work Injury Damages claim.

In this part we will review the principles that are fundamental to the assessment of liability for breach of duty and we will consider the circumstances that might give rise to a vicarious liability in the employer. Causation and its importance as part of the initial assessment will also be discussed.

In Part 2 in October 2024 we will look at the principles that apply to the assessment of quantum. The importance of particulars will be reviewed and we will deal with specific matters that need to be considered in the defence such as contributory negligence, mitigation and the limitation period.
