Adam is a Partner in our Dispute Resolution & Advisory team. He has experience working across boutique, national and mid-tier firms where he has gained valuable expertise in a wide range of general commercial disputes, with a focus on debt recovery and insolvency.

Adam’s in depth knowledge of the law surrounding commercial disputes and insolvency allows him to develop strategies for his clients to  help them efficiently and effectively manage the litigation process from inception to completion. He assists his clients with contractual disputes, creates strategies to manage debts and recently represented group members in a commercial class action before the Supreme Court of New South Wales.

Adam has a strong focus on establishing, building and maintaining client relationships and recognises the fact that each client’s circumstances are inherently different to the next. With a proven track record of developing such relationships, this recognition allows Adam to tailor his strategy and advice to each client and the relevant circumstance in order to obtain the most efficient and effective resolution of each dispute.

Career highlights

  • Acting for 1,265 group members in a class action commenced in the Supreme Court of New South Wales seeking relief for breaches of the consumer guarantees pursuant to Schedule 2 of the Competition and Consumer Act 2010 (Cth), unconscionable conduct and unjust and unfair provisions and seeking damages for both economic and non-economic losses sustained as a result of those breaches.

  • Successfully representing a mid north coast civil construction company in multiple claims against various Councils on account of breaches of contract, breaches of tender obligations, enforcing rights to call on an option contained in pro-form tender documents and defending claims for defective works and delay.

  • Successfully obtaining orders and declarations from the Supreme Court of New South Wales to the effect that the parties to the litigation, in correspondence, had formed a legally binding agreement so as to settle the subject matter of the dispute. This order was sought as a result of one party alleging that no such settlement had taken place.

  • Advising, acting for and successfully obtaining orders in the Supreme Court of New South Wales restraining a previous director and employee of the client from commencing and carrying on a directly competing business, and proving breach of the relevant employment contract and fiduciary obligations.

  • Successfully obtaining an order for specific performance requiring the executor of a deceased estate to transfer the deceased’s shareholding in a company for nominal consideration pursuant to the provisions of an applicable Shareholder’s Agreement.

     

Specific areas of focus

  • Providing advice and acting on behalf of individuals and companies in relation to contractual disputes including disputes arising out of tender documentation and specifications.

  • Assisting clients in creating effective strategies to manage debts within their organisation and acting for and advising on the recovery of those debts including, when required, orders seeking to wind up insolvent companies or bankrupt individual debtors.

  • Advising clients on their rights and obligations under the Australian Consumer Law with particular focus on claims for breaches of the statutory guarantees and for or deceptive conduct in trade or commerce.

  • Reviewing, advising on and negotiating amendments to commercial contracts, procurement documentation and tender specifications.
